Turkish court launches probes against two judges over recordings

The presidency of the Supreme Court of Appeals has launched investigations into two senior judges who were implicated in two separate voice recordings, drawing ire with their controversial remarks.

One of the probes was launched against Hamdi Yaver Aktan, a member of the Supreme Court of Appeals 8th Chamber, over a voice recording in which he allegedly agreed to reverse an earlier court decision at the request of an unknown man.

In the voice recording, the unidentified man asks whether Aktan is done with a file.

“Hey, you are early. I was planning to prepare the file this afternoon,” Aktan says upon seeing the man, most probably in his office at the Supreme Court of Appeals. The man says he has no time to waste and asks the judge to immediately prepare the file. “The members of the Supreme Court of Appeals and the president of the court, I will kill you all,” the man is heard saying in the recording. Then the two agree to prepare the file, which concerns a few members of a criminal group who were sentenced to two years by a local court, on Wednesday.

The other investigation launched by the Supreme Court of Appeals presidency concerns the head of the 11th Criminal Chamber, Ersan Ülker.

In a voice recording recently published by the dailmotion.com web site, Ülker allegedly used foul language against Supreme Court of Appeals President Hasan Gerçeker, complaining that the president was frequently going abroad, not sparing time for the high court's problems. As Ülker is also a member of the board who will oversee the probe, he is expected to leave his post. He is also the most likely to replace Gerçeker as president of the court when Gerçker's term ends in June.

Ülker is also remembered for being mentioned in another voice recording, which hit websites in early June last year, where top judges at the high court were planning to release Erzincan Chief Public Prosecutor İlhan Cihaner, currently a key suspect in an ongoing terror investigation. The speakers in the recording are allegedly Supreme Court of Appeals judges Aktan and Fatih Arkan. Aktan was heard telling Arkan that he had offered Ülker the leadership of the Supreme Court of Appeals if he could ensure that the two cases against Cihaner were merged and Cihaner was freed from prison. The prosecutor's release transpired exactly as suggested in the recording.
